1. What Picks is

Picks ("Picks", "we", "us", or "our") operates picksclub.net, a sports-prediction tracker and social network. Picks lets you manually log ("track") sports bets that you placed at your own, separate, third-party sportsbook, automatically verifies the outcome of those predictions using publicly available sports results, builds a track record from them, and ranks users on leaderboards with trophies, leagues, and seasons.

Picks is not a sportsbook, casino, or gambling operator. We never accept wagers, never hold or pay out money, never set or offer odds for you to bet against, and never facilitate gambling of any kind. Any odds you enter are figures you obtained from your own sportsbook and are recorded purely to track the result of a bet you already made elsewhere. No money is ever staked, escrowed, won, or paid through Picks.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account and use Picks. By using Picks you represent that you meet this requirement and that your use of Picks, and any betting you may separately and independently conduct at a third-party sportsbook, is lawful where you live. You are solely responsible for complying with all laws that apply to you.

3. Your account

You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. You agree to provide accurate registration information and to keep it current. Notify us promptly at support@picksclub.net if you suspect unauthorized use of your account.

4. Self-reported picks

Picks displays predictions and records that users enter themselves. Bets are placed by you at your own sportsbook; you then log them on Picks for tracking and comparison. We do not independently confirm that a logged bet was actually placed, nor the stake, odds, or terms you enter. Records, win rates, returns, and rankings are informational only, may contain errors, and must not be treated as a guarantee of any past or future result. Nothing on Picks is betting, investment, financial, or professional advice.

5. Picks Pro subscription

"Picks Pro" is an optional paid subscription to software features (currently US$5.99 per month, or a free trial where offered). It is a standard software-as-a-service subscription for access to app features only. It is not a wager, a deposit, a stake, an entry fee into any game of chance, or a payment that can be won or lost. Subscribing buys nothing other than access to features.

Subscriptions renew automatically each billing period until cancelled. You may cancel at any time from your account settings; cancellation stops future renewals and you keep Pro access until the end of the period you already paid for. Prices and features may change on a going-forward basis with notice. Payments are processed by third-party payment providers subject to their own terms; except where required by law, subscription fees are non-refundable.

Card tokenization and recurring billing. When you subscribe to Picks Pro using a card through a payment provider that supports recurring billing (such as PayPhone in Ecuador), you expressly authorize that provider and Picks to securely store a token representing your card (we never store your full card number) and to automatically charge the recurring subscription fee — currently US$5.99 per month — to that card each billing period, on the same date, until you cancel. You confirm you are the cardholder or are authorized to use the card. You may revoke this authorization at any time by cancelling your subscription from your account settings, which stops all future charges. You will be asked to accept this authorization explicitly at checkout before any card is charged.

6. Acceptable use

You agree not to:

• use Picks to place, accept, broker, or facilitate any wager, or to receive or transmit gambling money through the platform;
• post content that is unlawful, fraudulent, harassing, hateful, defamatory, obscene, or that infringes others' rights;
• impersonate any person or misrepresent your affiliation, or falsify your records to mislead other users;
• spam, scrape, or use bots, or otherwise interfere with, overload, or attempt to gain unauthorized access to the service or other accounts;
• solicit money from other users in a deceptive way, or use Picks for any illegal activity; or
• circumvent, disable, or tamper with any security, rate-limiting, or access-control feature.

We may remove content or restrict accounts that, in our reasonable judgement, violate these terms.

7. User content and intellectual property

You retain ownership of the picks, posts, comments, and other content you submit ("User Content"). You grant Picks a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your User Content for the purpose of operating, promoting, and improving the service (for example, showing your picks in feeds, leaderboards, and share images). You are responsible for your User Content and represent that you have the rights to post it.

The Picks name, logo, design, software, and all other materials we provide are owned by Picks or our licensors and are protected by intellectual-property laws. You may not copy, modify, or create derivative works from them except as expressly permitted.

8. Third-party services and data

Picks relies on third-party sports-data and payment providers. We do not control and are not responsible for third-party services, their availability, or their accuracy. Sports results and odds data may be delayed, incomplete, or wrong; verification of a pick may be corrected if underlying data changes.

9. Disclaimers

Picks is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that records, statistics, or rankings are accurate or complete. You use Picks at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Picks and its operators, owners, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or — for the avoidance of doubt — any gambling losses you incur at any third-party sportsbook, arising out of or related to your use of (or inability to use) Picks. Our total aggregate liability for any claim relating to the service will not exceed the greater of the amount you paid us for Picks Pro in the twelve months before the claim, or US$50.

11. Indemnity

You agree to indemnify and hold harmless Picks and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the service, or your breach of these terms.

12. Suspension and termination

You may stop using Picks and delete your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these terms or to protect the service or other users. Sections that by their nature should survive termination (including content licence, disclaimers, limitation of liability, and indemnity) will survive.

13. Changes to these terms

We may update these terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of Picks after changes take effect constitutes acceptance of the revised terms.
